Terms of Service
Last updated: 20 March 2026These Terms of Service govern your use of pointeehq.com and the Pointee process-automation platform (together, "the Service") operated by Pointee s.r.o. ("the Company," "we," "us," or "our"). Pointee builds UI-layer automation for back-office operations at banks and insurers -- the Service includes the discovery observation engine, process-mapping tooling, automation execution layer, and exception-routing components described at pointeehq.com/platform.html.
1. Agreement
These Terms form a binding agreement between you and the Company. By accessing or using the Service, you confirm that you have read, understood, and accepted these Terms. If you do not accept them, do not use the Service.
If you are a consumer (a natural person acting outside your trade, business, craft, or profession), nothing in these Terms limits your statutory consumer rights under your country of residence.
For organisations accessing the Service under a separate subscription or enterprise agreement, those agreement terms take precedence where they conflict with these Terms.
2. Use of the Service
Access to the full Pointee platform requires registration and acceptance by the Company. By requesting access through pointeehq.com/ops/, you represent that you have the authority to bind your organisation to these Terms.
- You must be at least 18 years old or have parental consent to use the Service.
- You agree not to use the Service for unlawful purposes, to interfere with its operation, or to attempt unauthorised access to systems or data.
- You may not copy, scrape, or reverse-engineer the Service except as permitted by mandatory applicable law.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
3. Intellectual Property
The Service, including all content, software, process-discovery algorithms, documentation, and visual design, is owned by the Company or its licensors and is protected by EU and international intellectual-property law. You receive a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose during the term of your subscription. No other rights are granted.
4. Client Data and Process Observation Data
To deliver process discovery and automation, Pointee observes interactions between your operators and your existing back-office systems. You retain ownership of all process observation data, workflow maps, and any business data captured in the course of providing the Service to you.
You grant the Company a limited licence to use, store, and process this data solely to provide the Service and to improve service reliability. We do not use your process observation data to train machine-learning models without your explicit written consent. Enterprise tier clients may request a GDPR data-processing agreement covering the Company's processing of client personal data as a processor under Article 28 GDPR.
5. Right of Withdrawal (Consumer Contracts)
Where you enter into a paid contract with the Company as a consumer at distance, you have the right to withdraw within 14 days under the EU Consumer Rights Directive without giving any reason. To exercise the right, contact us at [email protected] with a clear statement of withdrawal. The Company will refund all payments received within 14 days.
The Service as currently offered to organisations does not typically involve consumer contracts. This clause applies only if and when the Company offers paid services directly to natural persons acting as consumers.
6. Disclaimers and Statutory Guarantees
The Service is provided on an "as is" basis. Nothing in these Terms excludes or limits the Company's liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded under mandatory law. Statutory guarantees that apply to consumers under EU law are not affected.
7. Limitation of Liability
To the extent permitted by law, the Company's total liability for any claim arising from or related to the Service will not exceed the amount you paid to the Company in the three months preceding the event giving rise to the claim, or EUR 100 where no payment has been made. This limitation does not apply to liability that cannot be limited under mandatory law (see Section 6 above).
8. Termination
The Company may suspend or terminate your access for material breach of these Terms, non-payment, or conduct that poses a security or legal risk. You may terminate your subscription by giving the notice period specified in your subscription agreement. Sections 3, 4, 6, 7, 9, and 10 survive termination.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of the Czech Republic.
The courts of Prague, Czech Republic have exclusive jurisdiction over any dispute arising from or related to these Terms, subject to mandatory consumer-protection rules of your country of residence (Article 17-19, Regulation (EU) No 1215/2012). If you are a consumer, you may also bring proceedings before the courts of your country of habitual residence, and the Company may sue you only in those courts.
The European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr. The Company does not commit to using this platform but will cooperate where required by law.
10. Changes
The Company may update these Terms. Material changes will be posted with a new "Last updated" date at the top of this page. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. For registered platform users, the Company will provide reasonable advance notice of material changes.
